Performance and Discharge of the Contract || Indian Contract Act, 1872 Video

Performance of the Contract is the most usual mode of extinction of an obligation arisen out of the contract between parties.
Section 37 of Indian Contract Act, 1872 provides that the parties to a contract must either
(i) perform their promises, or
(ii) offer to perform the same and unless such performance is dispensed with or excused under the provisions of this Act, or of any other law.

Performance can be:
(1) Actual, or
(2) Attempted

While Discharge of Contract means extinguish of rights and obligations of the contract.
